Citizens of the European Union

There are no restrictions on the purchase or sale of property.

Non-EU citizens

They may acquire property without any issues, as long as they meet the current administrative requirements.

Foreign buyers

  • Obtaining the N.I.E. (Foreigner Identification Number)

  • An essential document for signing deeds and conducting banking transactions in Spain

Spanish citizens

  • Submission of a valid D.N.I.

1. Reservation of the property

Once the home has been selected and the price agreed:

  • A reservation document is signed

  • The property is taken off the market

  • A deposit is paid, normally between €3,000 and €10,000, depending on the value of the property

2. Private purchase option contract

After the legal review, a contract is formalized that includes:

  • Agreed price

  • Inventory included

  • Payment method

  • Date of signature before a notary

At this point, you pay the 10% of the total price, deducting the amount paid at the time of the reservation.

If you don’t have a lawyer, we recommend multilingual professionals specialized in local Real Estate Law.

3. Signing the public deed

Before signing at the notary’s office:

  • Final review by the notary and the lawyer

  • Full reading of the deed

  • Signature by both parties

  • Handing over the keys

Afterwards, the notary sends the deed to the Land Registry, where the ownership is officially formalized.

Second-hand properties

  • Transfer Tax (Impuesto de Transmisiones Patrimoniales - ITP)

    • 9 % up to €999,999

    • 11 % from €1,000,000

  • Notary and land registry fees: approx. between €1,500 and €2,000

New-build homes

  • 10 % VAT

  • 1.4 % on Documented Legal Acts (Actos Jurídicos Documentados - AJD)

Plots of land

  • First transfer: 21 % VAT

  • Second transfer: 10 % Transfer Tax (ITP)

The real estate commission is included in the sale price, unless otherwise agreed.

  • IBI (Property Tax)

  • Waste collection fee (garbage)

Both are paid once a year (usually in autumn) and vary depending on the municipality.
