Who can buy property in Spain?

Citizens of the European Union

There are no restrictions on buying or selling property.

Non-EU citizens

They can acquire properties without inconvenience, as long as they comply with the current administrative requirements.

Basic requirements for purchase

Foreign buyers

  • Obtaining the N.I.E. (Foreigner Identification Number)
  • Essential document to sign deeds and bank in Spain

Spanish citizens

  • Presentation of a valid ID card

Phases of the purchase process

1. Reservation of ownership

Once the property has been selected and the price has been agreed:

  • A booking document is signed
  • The property is withdrawn from the market
  • A deposit is usually paid between €3,000 and €10,000, depending on the value of the property

2. Private purchase option contract

After the legal review, a contract is formalized that includes:

  • Agreed price
  • Inventory included
  • Payment method
  • Date of signature before a notary

At this time, 10% of the total price is paid, deducting the amount paid in the reservation.

If you do not have a lawyer, we recommend multilingual professionals specialized in local Real Estate Law.

3. Signing of the public deed

Before signing at the notary's office:

  • Final review by the notary and the lawyer
  • Full reading of the writing
  • Signature by both parties
  • Key handover

Subsequently, the notary sends the deed to the Land Registry, formalizing the ownership.

Expenses associated with the purchase and sale

Second-hand properties

  • ITP (Property Transfer Tax)
    • 10% up to €999,999
    • 11 % from €1,000,000
  • Notary and registry fees: between €1,500 and €2,000 approx.

New build homes

  • 10% VAT
  • 1.5% of Stamp Duty (AJD)

Pitches

  • First transfer: 21% VAT
  • Second transmission: 10% ITP

The real estate commission is included in the sale price, unless otherwise agreed.

Subsequent annual expenses

  • IBI (Property Tax)
  • Waste collection fee (garbage)

Both are fertilized once a year (usually in autumn) and vary according to the municipality.
